1. Who you are contracting with
Foundlete is operated by Desialth ("Desialth", "we", "us"). These Terms & Conditions form the agreement between you and Desialth for your use of the Foundlete app and website (the "Service").
By creating an account, subscribing, or continuing to use the Service you agree to these terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind it. If you use it as an individual, you confirm you are of legal age in your country.
2. The Service
Foundlete helps founders and high-performers track readiness, run daily training and recovery protocols, organise wellness meetups, and keep a morning notes journal in which you photograph handwritten pages that we transcribe and summarise for you.
Foundlete Pro is a paid subscription that unlocks the full protocol library and unlimited custom protocols.
3. Your account
Keep your login credentials confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date.
4. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose or in breach of applicable law;
- engage in fraud, spam, or abuse of other members or meetup hosts;
- infringe anyone's intellectual property, privacy, or other rights — including uploading photographs of notes or content you do not have the right to upload;
- interfere with the security or integrity of the Service: malware, probing, penetration testing, scraping, or circumventing rate limits or technical restrictions;
- reverse engineer, resell, or redistribute the Service.
5. Morning notes, uploads and automated analysis
You keep ownership of the notes, photographs and other content you upload. You grant Desialth a limited licence to host, store and process that content solely to provide the Service to you — including sending your note images to our AI processing provider so they can be transcribed, structured and summarised.
Automated transcriptions, summaries and observations may be inaccurate or incomplete. They are informational only and are not medical, psychological, financial or other professional advice. Always verify anything important yourself and consult a qualified professional where appropriate.
If you believe content on the Service infringes your rights, contact us and we will review and, where appropriate, remove it. We may remove content, refuse or filter outputs, and suspend accounts for repeated or serious violations.
6. Health and wellbeing disclaimer
Protocols, breathwork sessions, readiness scores and meetups are general wellness content, not medical advice or treatment. Train within your limits and seek medical guidance before starting any new physical or breathing practice.
7. Licence and intellectual property
Desialth retains all rights in the Service, including its software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with the plan you have selected.
8. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, renewals, cancellations and refunds are handled under Paddle's Checkout Buyer Terms. Subscriptions renew automatically each month or year until cancelled. If you cancel, you keep Pro access until the end of the period you have already paid for. Upgrades take effect immediately (prorated by Paddle); downgrades take effect at your next renewal. 9. Availability
We work to keep Foundlete reliable, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, and we may change or discontinue features.
10. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination your access ends; you can export or delete your morning notes from within the app beforehand, and we will delete remaining data in line with our Privacy Notice.
11. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
You will indemnify Desialth against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
12. General
You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the jurisdiction in which Desialth is established, and disputes will be heard by the courts of that jurisdiction.
